Terms and Conditions for Grandify AI

Welcome to Grandify AI ("we", "our", "us"). By accessing or using our services, including the Grandify AI application and website (https://grandify.aceit-ai.co.za), you agree to comply with and be bound by these Terms and Conditions ("Terms"). By using Grandify AI, you affirm that you are at least 18 years of age or have parental consent to use our services. You agree to comply with all applicable laws and regulations regarding your use of the services.

Grandify AI is an AI photo creation app that transforms a user-supplied face photo, combined with an AI prompt, into realistic or fantasy-style images. Our services are powered by AI models designed to generate creative and unique images.

3. User Responsibilities

3.1 Account Security:

• You are responsible for maintaining the confidentiality of your account information and password. You agree to notify us immediately of any unauthorized use of your account.

3.2 Lawful Use:

• You agree to use our services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the services.

3.3 Content:

• You are solely responsible for any content you upload, generate, or share through our services. You warrant that you have the necessary rights to use and distribute such content.

4. Limitation of Liability

4.1 Disclaimer:

• Our services are provided "as is" and "as available" without any warranties, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components.

4.2 Limitation of Liability:

• To the maximum extent permitted by law, Grandify AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses.

4.3 Indemnification:

• You agree to indemnify and hold Grandify AI harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the services or any violation of these Terms.

5. Intellectual Property

All content, trademarks, and other intellectual property on the Grandify AI app and website are the property of Grandify AI or its licensors. You may not use, reproduce, or distribute any such content without our express written permission.

6. Modifications to Services and Terms

We reserve the right to modify or discontinue our services, or any part thereof, at any time without notice. We also reserve the right to change these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the services following any changes constitutes acceptance of the new Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. You agree to submit to the exclusive jurisdiction of the courts located in South Africa to resolve any legal matter arising from these Terms.

We reserve the right to terminate or suspend your access to our services, without prior notice or liability, for any reason, including if you breach these Terms.

9. Paid Accounts

9.1 Billing:

• If you purchase any Services, you will provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel. You’re responsible for all applicable taxes, and we’ll charge tax when required. If your payment cannot be completed, we may downgrade your account or suspend your access to our Services until payment is received.

9.2 Cancellation:

• You can cancel your paid subscription at any time. Payments are non-refundable, except where required by law. These Terms do not override any mandatory local laws regarding your cancellation rights.

9.3 Changes:

• We may change our prices from time to time. If we increase our subscription prices, we will give you at least 30 days’ notice and any price increase will take effect on your next renewal so that you can cancel if you do not agree to the price increase.

10.1 Minimum Age:

• You must be at least 13 years old or the minimum age required in your country to consent to use the Services. If you are under 18 you must have your parent or legal guardian’s permission to use the Services.

10.2 Registration:

• You must provide accurate and complete information to register for an account to use our Services. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. If you create an account or use the Services on behalf of another person or entity, you must have the authority to accept these Terms on their behalf.
